This website is owned and operated by Access Literacy, LLC. These Terms set forth the terms and conditions under which you may use our website and services as offered by us.
This website offers visitors information about our K-3 reading program, Literacy Essentials: The Journey From Spelling To Reading, provides tools to individuals using or intending to use the program, the Shop for purchasing the student notebook (My Orthography Notebook), access to our publisher’s online storefront to purchase the program components, and the opportunity to request training or support from Access Literacy, LLC. By accessing or using the website of our service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

Who can use the website and what are the requirements for an account?
In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you.

What are the commercial terms with our customers?
When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the invoice page that you will receive via email.
The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

Terms and Conditions of Sales
When ordering materials, you will be asked to provide specific information. You acknowledge and agree that all the information is correct, current and complete and you agree to be bound by the terms and conditions of the Privacy Policy and actions we take with this Privacy Policy.

Orders will be filled based on the “need-by” date on the order details; however, you must allow a minimum of 15 busines days from the date of the invoice approval.

Shipping tracking numbers will be sent to the email address of the contact person. It is the sole responsibility of that person to coordinate with the shipping company for delivery. Customer agrees to pay reshipment costs if product is returned because an incorrect address was provided when ordering or the purchaser failed to coordinate proper acceptance of the shipment.

Returns, refunds, shipment quantity errors
Purchases are eligible for return of undamaged product and a full refund within 14 days of delivery. Return shipping is paid for by the purchaser. We will offer a refund based upon the original payment method.

Claim for defects
For order shipments where there is a claim for defects, damages, or shortages, notification must be made by the customer in writing. Save all packaging and we will need pictures as proof of the condition of the original shipping packages, book conditions and quantity to verify the error within 48 hours of arrival.

Retention of right to change offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

Ownership of Intellectual Property, Copyrights and Logos
The Website and its entire contents, features, functionality, and information, including, but not limited to all software, images, text, graphics, video, audio, logos, trademarks, copyrights, photographs, and the design, selection, and arrangement of the Website, and all Intellectual Property Rights related thereto are owned by Access Literacy LLC, its licensors or service providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You acknowledge and agree that nothing contained in these Terms of Use convey any right, title or interest in or to the Website or any intellectual property incorporated therein.
Under these Terms of Use, you are only permitted to use the Website for your personal, non-commercial use. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website, except as required by your computer and internet web browser to display the Website on your computing device. You are expressly prohibited from:
(a) Modifying copies of any materials from the Website.
(b) Using any illustrations, photographs, video, audio, or any graphics contained on the Website except as expressly stated on the Website.
(c) Deleting or altering any copyright, trademark, or other proprietary rights notices from copies of materials on or from the Website.

Right to suspend or cancel user account
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.

You agree to indemnify and hold Access Literacy, LLC harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in Columbus, Ohio. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.
